Is CBD Legal in Texas? Yes, With 2026 Limits
Short answer: Yes. Hemp-derived CBD is legal in Texas when the product contains no more than 0.3% THC by dry weight (now measured as total THC, including THCA) and no banned THC isomers like delta 8. Since October 2025, anyone selling hemp products in Texas must check ID and sell only to customers 21 and older. CBD vapes can't be sold in Texas. For every other product, see Is THC Legal in Texas?

What makes CBD legal in Texas?
Texas legalized hemp and hemp-derived CBD in 2019 through House Bill 1325, now Chapter 443 of the Health and Safety Code. The Department of State Health Services (DSHS) runs the Consumable Hemp Program, which licenses manufacturers, registers retailers and sets testing rules. Since March 31, 2026, a manufacturer license costs $10,000 a year per facility and a retail registration costs $5,000 a year per location. A legal CBD product in Texas must:
- Come from a Texas-licensed manufacturer or a compliant out-of-state manufacturer, and be sold by a licensed or registered seller. Products made out of state must meet the same Texas standards (25 TAC §300.403).
- Be tested by a lab, with a certificate of analysis (COA) that shows its cannabinoid content.
- Stay within the THC limit and contain no banned THC isomers.
How old do you have to be to buy CBD in Texas?
21. DSHS first set the age limit in emergency rules adopted in October 2025. Permanent DSHS rules (25 TAC §300.701 and §300.702) replaced them on March 31, 2026. They bar licensed and registered hemp sellers from selling consumable hemp products to anyone under 21 and require a valid government-issued ID. The rules cover all consumable hemp products, CBD included. Stores licensed by the Texas Alcoholic Beverage Commission have followed the same age limit since October 1, 2025.
Are CBD vapes legal in Texas?
No. Senate Bill 2024, in effect since September 1, 2025, bans selling or marketing vape products that contain any cannabinoids, and CBD is a cannabinoid. The law targets sale and marketing, and it has an exception for prescriptions under the Compassionate Use Program. See Are THC vapes legal in Texas?
Does full-spectrum CBD matter in Texas?
It can. CBD products come in three main types:
- Full-spectrum: contains a range of cannabinoids from the plant, including small amounts of THC.
- Broad-spectrum: multiple cannabinoids, with THC removed or reduced to trace levels.
- Isolate: CBD only.
Full-spectrum products still have to pass the 0.3% limit, and since March 31, 2026, Texas counts THCA as well as delta 9 toward that limit. Since July 31, 2026, delta 8 has also been a controlled substance in Texas, so a product with more than naturally occurring trace amounts of delta 8 is out of compliance. See Is delta 8 legal in Texas? Check the product's COA for its total THC and other cannabinoids.
Is CBD flower legal in Texas?
Sometimes. Texas bans manufacturing smokable hemp in the state, and the total THC rule now counts THCA in flower. CBD flower that stays under 0.3% total THC can qualify as hemp, and flower made out of state must meet Texas standards. Many hemp flower products fail the limit, and whether possessing flower that fails it is a crime isn't settled. See Is THCA legal in Texas?
What changes for CBD on December 11, 2026?
Most changes to the federal definition of hemp take effect on December 11, 2026. One exclusion, for cannabinoids the plant can't naturally produce, takes effect earlier, on November 12, 2026. From December 11, finished hemp products will be limited to 0.4 mg of total THC per container. Many full-spectrum CBD products contain more THC than that per bottle, so they may no longer qualify as federal hemp. CBD isolate and broad-spectrum products are less likely to be affected.
The December date comes from H.R. 6500 (Public Law 119-103), a stopgap funding law signed September 2, 2026, which moved it from November 12. That funding also expires December 11, so Congress could move the date again. As of mid-October 2026, the FDA had not yet published the cannabinoid lists or the "container" guidance the new law calls for. Details are on the main Texas THC page.
Is CBD the same as the Texas Compassionate Use Program?
No. Hemp-derived CBD is sold at retail under the hemp rules. The Compassionate Use Program is a separate medical program in which registered doctors prescribe low-THC cannabis from state-licensed dispensaries. See the Texas Compassionate Use Program.
Where can I compare CBD prices?
Compare prices on CBD tinctures, CBD edibles, CBD topicals and CBD capsules. Each store sets its own shipping rules, so confirm that a product ships to Texas before you order. CBD gummies are covered on Are THC gummies legal in Texas?
