Texas Law: Shipping, pile of brown cardboard shipping boxes

Can You Ship or Order THC to Texas?

Short answer: Only products that are legal in Texas. In practice, that means delta 9 hemp edibles and drinks at or under 0.3% total delta 9 THC (including THCA) by dry weight, and non-vape CBD products, for adults 21 and older. Delta 8, most THCA flower and all cannabinoid vapes don't qualify, and some online stores block Texas addresses for them. Federal changes on November 12 and December 11, 2026 could narrow what ships to any state. For every product, see Is THC Legal in Texas?

Last checked: October 26, 2026. This page is general information, not legal advice. Texas hemp rules are changing quickly and several are being challenged in court.

What hemp products can be shipped to Texas?

Product Can it ship to Texas?
Delta 9 hemp gummies, edibles and drinks (0.3% or less total delta 9 THC, including THCA, by dry weight) Yes, to adults 21+, under carrier rules. Federal status changes December 11, 2026
CBD oils, gummies, capsules and topicals Yes, to adults 21+
Delta 8, delta 10, THCP and other THC isomers No. Schedule I in Texas since July 31, 2026 (being challenged in court)
THCA flower, pre-rolls and concentrates Generally no. Most fail the Texas total THC test
Any cannabinoid vape, including CBD No. Sale banned in Texas since September 1, 2025, and barred from the U.S. mail since October 21, 2021

Texas rules have no separate provisions on online sales or shipping. Under DSHS rules, products that don't comply may not be sold, distributed or transported in Texas, and interstate transport follows federal law.

Why do online stores block Texas addresses?

Texas began applying a total THC limit that counts THCA on March 31, 2026, and scheduled delta 8 and other THC isomers on July 31, 2026. Since then, some online stores have stopped shipping those products to Texas, and some block Texas orders for anything containing THC. If a store blocks your order, that's usually why.

The delta 8 scheduling is being challenged in court. A temporary-injunction hearing in the Travis County suits is set for October 30, 2026, and no court order was blocking the scheduling as of October 26, 2026. See Is delta 8 legal in Texas? and Is THCA legal in Texas?

Do you have to be 21 to order hemp products online in Texas?

Yes. Texas rules bar anyone selling or delivering consumable hemp products from providing them to a person under 21, and require a check of a valid, unexpired government-issued photo ID before the sale. The rules don't spell out how online ID checks must work. Many online stores verify age at checkout, and UPS requires an adult signature for hemp product deliveries.

Do shipping carriers allow hemp products?

Yes, with limits. Each carrier sets its own rules:

  • USPS: Allows domestic mailing of hemp and CBD products with 0.3% THC or less under the federal hemp definition, if the mailer complies with all federal, state and local laws and keeps compliance records for 3 years. International and military (APO/FPO/DPO) mailing is not allowed.
  • USPS vapes: Cannabis, hemp and CBD vapes have been non-mailable to consumers under the federal PACT Act rule since October 21, 2021.
  • UPS: Accepts hemp derivatives only where legal and requires Adult Signature Required on domestic shipments. It prohibits hemp products meant to be inhaled as an aerosol and synthetic or lab-made cannabinoids. UPS updated its policy in October 2026; from December 11, 2026, raw hemp shipments need a COA showing 0.3% or less total THC.
  • FedEx: Has reportedly allowed hemp products at 0.3% THC or less under its terms and does not ship vaping products. Check fedex.com for its current terms.

As of October 19, 2026, USPS and FedEx had not been reported to have updated their policies for the federal change.

What changes for shipping on November 12 and December 11, 2026?

A new federal hemp definition, passed in November 2025, takes effect in two steps:

  • November 12, 2026: Products made with cannabinoids the hemp plant can't produce naturally (synthetic or lab-made cannabinoids) stop counting as federal hemp.
  • December 11, 2026: The rest takes effect, including a cap of 0.4 mg of combined total THC and other cannabinoids with similar effects per container (the innermost retail package).

Products above that cap would no longer be federal hemp. USPS ties mailability to the federal hemp definition, so this would affect shipping to every state, not just Texas. December 11 is also the day current federal stopgap funding expires, so Congress could move the date again, or it may not. Details are on the main Texas THC page.

Where can I compare products that ship to Texas?

Compare prices on delta 9 THC, CBD edibles and CBD tinctures. Each store sets its own shipping rules, so confirm that a product ships to Texas before you order. For what's legal in each format, see Are THC gummies legal in Texas? and Are THC vapes legal in Texas?
